Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Digital Testament service ("Service") operated by Digital Testament ("we", "us", "our"), based in the Republic of Poland. By creating an account or otherwise using the Service you agree to be bound by these Terms.

1. Introduction & Acceptance

By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy. If you do not agree, do not use the Service. These Terms are effective as of the "Last updated" date above.

2. Definitions

  • Service — the Digital Testament web application and related features made available at our website.
  • User — any person who creates an account and uses the Service.
  • Testator — a User who stores testament data through the Service.
  • Beneficiary — a person nominated by a Testator to receive released testament data upon a verified Release Trigger.
  • Testament Data — encrypted credentials, crypto wallet selectors, password vault entries, TOTP seeds, phone numbers, and other content you store in the Service for eventual release.
  • Release Trigger — the condition (e.g. verified death, prolonged inactivity with grace period) configured by the Testator that causes the Service to release Testament Data to Beneficiaries.
  • Account — the Testator's registered identity within the Service, secured by email and password.

3. Service Description

Digital Testament stores encrypted Testament Data supplied by the Testator and releases it to nominated Beneficiaries only after a Release Trigger is verified. The Service may include password vaults, crypto wallet references, beneficiary management, and configurable grace periods.

Important: the Service is not a legal will and does not replace a notarial testament, probate, or any formal succession procedure under Polish or other applicable inheritance law. It is a complementary tool for passing digital assets and credentials. Consult a qualified notary or lawyer for your formal legal will.

4. Account Registration

Registration requires a valid email address and password. We use reCAPTCHA to prevent abuse. You must be at least 18 years old and legally capable of entering into a binding contract. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for activity under your Account.

5. User Obligations

  • Keep your account credentials, master keys, and release-trigger configuration confidential and secure.
  • Only upload content you lawfully own or are authorised to transfer.
  • Do not store illegal content, malware, or material that infringes third-party rights.
  • Keep beneficiary contact details and relationship information accurate and current.
  • Notify us promptly if you suspect unauthorised access to your Account.

6. Subscription & Payment

Paid plans are billed in EUR through Stripe. Subscriptions renew automatically for the period selected until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. Except where required by mandatory consumer-protection law (including the 14-day right of withdrawal under EU law, where applicable), fees already paid are non-refundable. Taxes (e.g. VAT) are applied where required.

7. Release Trigger & Verification

A Release Trigger may include verified death (documentary evidence from a trusted party nominated by the Testator) or prolonged account inactivity followed by a grace period during which the Testator can cancel release. We will make reasonable efforts to verify the Trigger before releasing Testament Data, but we cannot guarantee timing, accuracy of documents submitted by third parties, or continuity of the Service.

We are not a party to, and are not liable for, disputes between Beneficiaries, between Beneficiaries and heirs, or over the authenticity of documents submitted to trigger release. Once Testament Data is released to a Beneficiary we cannot recall it.

8. Intellectual Property

The Service, its code, design, trademarks, and documentation are owned by us or our licensors. You retain ownership of your Testament Data. You grant us a limited, worldwide, royalty-free licence to store, process, encrypt, and transmit your Testament Data solely to operate the Service for you and deliver it to your Beneficiaries per your instructions.

9. Prohibited Use

  • Reverse engineering, decompiling, or probing the Service except as permitted by mandatory law.
  • Automated scraping, crawling, or load testing without our written consent.
  • Using the Service for money laundering, sanctions evasion, or any unlawful purpose.
  • Circumventing Release Trigger safeguards, grace periods, or Beneficiary verification.
  • Uploading content you do not own or are not authorised to transfer to Beneficiaries.

10. Termination

We may suspend or terminate your Account for material breach of these Terms, unlawful use, non-payment, or where required by law. You may delete your Account at any time from your settings. Deletion removes your Testament Data after a short grace window; once purged, we cannot recover it and no Release will occur.

11. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Release will execute against force majeure, blockchain or exchange failures, loss of keys, third-party outages, or events beyond our control.

To the extent permitted by law our aggregate liability to you for any claim arising out of or relating to the Service is capped at the total fees paid by you for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under Polish law (e.g. liability for wilful misconduct or gross negligence, or mandatory consumer rights).

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising out of your content, your breach of these Terms, or your misuse of the Service, to the extent permitted by applicable law.

13. Changes to Terms

We may update these Terms from time to time. For material changes we will notify you by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance. If you disagree, you may cancel and delete your Account before the effective date.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Poland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Disputes fall under the exclusive jurisdiction of the courts competent for the registered seat of the service provider in Poland, unless mandatory consumer-protection rules grant you the right to bring proceedings in your place of residence.
